#1554              Pine Woods Development, LLC                   Norwood Street

Applicant seeks zoning regulation exemptions to locate a 104 unit development under M.G.L., Ch. 40B for affordable housing that includes 54 buildings, including a clubhouse and wastewater treatment plant.  Property is identified as Pine Woods, Sharon and is located on Norwood Street and is situated in the Rural 1 Zoning District.

Attorney Shelmerdine provided a revised pro-forma letter dated 11/7/07.

Paul Oliveira, 255 Norwood St. letter dated 11/10/06

Beth Green, 11 Huckleberry Ln. letter dated 11/9/06.

Attorney Witten’s letter dated 10/27/06.

Town of Walpole letter dated 11/1/06.

Richard Gelerman, Town Counsel letter dated 10/25/06.

Coler & Colantonio letter dated 11/13/06.

 

Kelly Killeen, Coler & Colantonio, reviewed the documented dated 11/13/06.  Stated the project consists of 104 units (43 duplexes, 1 (18) unit apartment building), that Mass Audubon abuts 2 side of the project, road 4 main entrance and all grades are in subdivisions.  Mr. Killeen identified the 2 storm water basins.  The storm water system/septic system are private and will be located off of Norwood St. It will be privately maintained and there is no presents of ground water.

 

Bill McGrath, Earth Tech letter dated 9/20/06. Mr. McGrath reviewed a few comments from this letter: 1) A new wet land was flagged within the 50ft. no disturb setback.  These setback requirements have not been met for the proposed building and grading located at the end of road 5.  2) The roadway and building layout should be reviewed by the Fire Department to ensure the adequate access is provided to and around each building. 3) The ownership status of Everett St. is unclear.  Is this road considered a public way and does Audubon Society/or other abutters have access to their property via Everett St.

Mr. Witten has concerned with site control on the southerly boundary on Everett St .and the size of the parcel.

 

Attorney Shelmerdine stated he will provided proof of full site control to Town Counsel.

 

Ronald Simons, issue is if the septic system pumping station has a power failure, will there be a back up system.

 

Kory Bluestein, Pondview Circle, concerned with the sewer system and the buffer zone.

 

Carol Weiner, 30 Blueberry Ln. concerned with the water supply.

 

Sharon Resident, Norwood St concerned with the storm water discharge and improvement of the storm water on Norwood St.

 

Eric Hudson, Bullard St.issues with preventing erosion both during construction and after.

 

Paul Oliveira, 255 Norwood St. concerned with the storm water run-off.

 

Jim Barron, Mansfield St. concerned with the wild life.

 

Eric Wendel, concern is with the 39 waivers for septic and storm water systems.

 

Sharon Resident, 7 Blueberry Ln., has issue with the leaching field and lift station.

 

Mr. Witten represents Mass Audubon.  Is concern with site design and with the new pro-forma.  He makes references to his letter dated 10/27/06.

 

Dave Martin’s question was will all the units have sprinkler.  Response was only the 18 unit apartment building will have sprinklers.

 

Carl Frank’s issue was with the size of the leaching field.

 

Planning Board Members concern was with the width of Everett St. and will it be paved.

 

Jim McMann’s concern is if the septic system pumps or tank fails. Who will be responsible.  Mr. Killeen responded that the project association is responsible.

 

John made a motion to have Town Counsel draft the decision and Applicant will pay for the services.  Board seconded the motion.

 

The Board requested that the Applicant submit the appraisal for the project.

 

The following issue to be discussed at the next meeting:

Site control (purchase, boundary), lift station: type of system, sewer, fire, traffic, appraisal issues, legal fees, loft and bedrooms, erosion control, ownership of Everett St., storm water and road grading, snow removal and issues with Mass Housing, waste water treatment plants.

 

Hearing continued until 1/14/07.  Attorney Shelmerdine refused to sign the continuance notice.

Next Zoning Board meeting is scheduled on December 6 at 8:00 p.m. in Town Hall Lower Hearing Room.
